What is the legal relationship between the trader and FundYourFX?

Your relationship with FundYourFX is governed by the Terms and Conditions you accept when you join. Under that agreement you take part as an independent contractor in a simulated proprietary trading program, not as an employee or partner.

The Terms and Conditions set out both sides' obligations: yours to trade within the program rules, and ours to provide access to the funded virtual trading environment and to pay your profit share according to those rules. In practice, the agreement governs three things:

  • The profit-sharing arrangement – how your share of simulated profits is calculated and paid out.
  • The program rules – the trading rules and risk limits you agree to follow while you take part.
  • What happens on a rule breach – how violations are handled, including soft and hard breaches and the point at which an account can be failed or closed.

Because you take part as an independent contractor, you are responsible for your own tax and legal position in your country of residence. For more on your status, see "Are the traders in FundYourFX contractors or employees?"

Are the traders in FundYourFX contractors or employees?

Traders with FundYourFX are independent contractors, not employees, partners, shareholders, or representatives. You have no authority to enter into agreements on behalf of FundYourFX.

What this means for you:

  • You are not entitled to employee benefits, wages, or protections.
  • You are responsible for your own tax obligations on any profits you receive.
  • You are free to trade for other firms or manage your own accounts at the same time.

The relationship is a simulated proprietary trading program: you agree to the Terms and Conditions that govern use of the platform and the profit-sharing arrangement. FundYourFX's obligation is limited to providing access to the funded virtual trading environment and paying out your profit share in line with the program rules.
